W&B Partner Jianguo Huang Provides Patent Litigation Training to FUJI XEROX
Upon the invitation of the Shanghai Branch Office of FUJI XEROX (China) Co., Ltd., on October 10, 2016 W&B partner Jianguo Huang provided patent litigation training to the FUJI XEROX management team. The one-day training session touched upon two sections -- Patent Infringement Litigation Practice and Patent Mapping Application and Preparation Basics.
In the section on patent infringement litigation practice, Mr. Huang began with basic legal concepts such as the means of legal protection of patent rights, patent infringement litigation proceedings, jurisdiction, matters subject to trial, and statutes and judicial interpretations applicable to patent infringement litigation. He elaborated on these concepts to provide an outline of patent infringement litigation in China in the form of a summary introduction followed by relevant details.
Mr. Huang then addressed features of the company’s day-to-day operations to elaborate on key issues in legal practice such as the elements for identifying patent infringement, types of patent infringement, principles for determining patent infringement and types of patent infringement liability. He used three typical patent infringement cases to better analyze and illustrate the relevant issues. The training session helped the FUJI XEROX team fully understand the significance of IP defense in day-to-day operations in a manner that combined theory, examples and experience-based conclusions.
The section on patent mapping application and preparation basics was divided into five topics: (i) patent mapping concepts and development (ii) patent mapping classifications (iii) forms of patent mapping (iv) fields of application and (v) the preparation process. This section aimed to provide the FUJI XEROX team with an understanding of how to fit patent mapping into a comprehensive and accurate patent intelligence analysis, so as to halve the work while doubling results when reading patent documentation.
Managers of various departments proactively questioned Mr. Huang, even to the point of vigorous discussions that centered on hot-button industry issues such as service inventions, the drafting of patent specifications and import sales. The training session will benefit the FUJI XEROX team’s efforts at IP defense and the regulation of day-to-day operations.
