Recently, W&B obtained favorable judgments for world-class clothing brand Zegna (杰尼亚) in a series of 21 trademark infringement lawsuits against a domestic company.

The domestic company’s brand had been comprehensively imitating Zegna’s brand image since 2011, thereby infringing Zegna’s IP rights. This company fabricated itsown brand history by appropriating Zegna’s brand history, inappropriately used a large number of promotional images that were taken from Zegna, imitated the fashion styles of Zegna-branded clothing, and even fabricated a claim of cooperation with Zegna. To evade legal responsibility, the company used trademarks that were slightly different from Zegna’s registered trademarks.

W&B attorneys Jean Yang and Yizhou Liu represented Zegna for the series of cases.Based on a thorough analysis of case facts, they worked out a careful and precise litigation plan -- they established Zegna brand’s popularity and reputation in Chinawith extensive evidence, and they used various details to prove that the domestic company possessed specific intent and obvious malice in its imitation of the Zegna brand. The weight of the evidence and the attorneys’ skillful and honest argumentspersuaded the court that the domestic company was “taking a free ride” on Zegna’s brand reputation. Ultimately, the court found the domestic company liable forinfringement, and ordered it to pay damages of over 2 million RMB.
