Public Opinions Sought on the Criminal Procedure Law (Draft Amendment)

The Criminal Procedure Law of the People's Republic of China (Draft Amendment) (the "Draft Amendment") has been recently deliberated at the Second Session of the Standing Committee of the 13th National People's Congress and released for public consultation by June 7, 2018.
The Draft Amendment contains major revisions as follows:

(1) improving the mechanism to have the criminal procedure law better aligned with the supervision law and adjusting the investigative functions and powers of people's procuratorates; the previous rules that people's procuratorates may exercise the right to open investigations into corruption and bribery cases are removed, and relevant procedural rules are updated accordingly as well;

(2) establishing the judgement by default mechanism for criminal cases, introducing the concrete procedures for the judgement by default when criminal suspects and defendants escape to places outside China's territory, and adding new rules that the judgement by default is permitted in a case where the trial is discontinued because of the defendant's serious disease or the defendant's death;

(3) making improvements to the leniency policy for suspects in criminal cases who plead guilty and accept punishments, and adding the rapid adjudication procedures that apply to cases under the jurisdiction of grassroots people's courts in which the defendants may be sentenced to up to three years in prison or lighter sentences and plead guilty and accept punishments, and the dispute over civil compensation has been resolved
